Definitions:
Event: The ‘Getting Away With Murder’ experience, and any aspect of any bookings associated with this Event.
Dr Friday (“Our”, “Us” and “We”) is any person involved with running the Event.
Customer (“You”) is any person who has purchased, won, or been given a ticket to attend the Event.
These terms and conditions (“Terms”) govern the basis on which Customer(s) will be admitted to the Event. Any person who does not comply with these Terms in full may be asked to leave the event, and no refund will be given.
1. Use of the Online Box Office
a) These Terms apply to tickets sold through Our online box office (“Website”). Please read these Terms carefully before placing your order. You acknowledge that by purchase you agree to be bound by these Terms. If you do not accept these Terms, you must not place an order for any of the tickets through the Website.
b) The information contained in this Website has been prepared solely for the purpose of providing information about the Event and making online bookings and must not be used for any other purpose.
c) By accessing this Website, you will be assuming all risks associated with the use of this Website, including risk of your computer, software or data being damaged by any virus which might be transmitted or activated via Our Website or your access to it.
d) You will only use this Website for personal private use.
2. Orders and Payment
a) The published price of the ticket (“Price”) includes any applicable taxes and booking or collection fees.
b) You acknowledge and agree that the Price may be subject to change and variation from time to time.
c) You shall pay for the tickets using one of the methods specified on the Website. Your Order shall not be placed until We have received your payment.
d) Your Order constitutes an offer to Us to buy tickets. All Orders are subject to acceptance by Us, and We will confirm such acceptance to You by sending You an e-mail attaching your Tickets subject to the order. The contract between us will only be formed when We send You the order confirmation (“Contract”).
e) It is your responsibility to check the Tickets that are subject to your order, and We are under no obligation to rectify any mistakes once the Contract has been formed.
f) We will not be responsible for any tickets that are lost, stolen or destroyed.
g) Bookings may only be made by persons over the age of 18. Where an individual is booking on behalf of others, that person must be authorised to make the booking on the basis of these Terms by all persons involved in the booking and by their parent or guardian for all party members who are under 18 when the booking is made.
3. Delivery
Tickets will be supplied by email. Your ticket can be shown to gain entry to the Event either as a print out, or on your phone. You may not be admitted to the event without a ticket. We shall not be liable for any failure by you to show your ticket.
4. Refunds and Exchanges
a) Unless otherwise expressly stated in these Terms, You will not be able to cancel an order after it has been accepted by Us, nor are You entitled to a refund for any tickets purchased by You, even if You are unable to attend the Event or if You arrive after your designated start time. Customers should arrive a minimum of 5 minutes prior to the Event start time that they have booked in order for the Event to start as scheduled. If Customers are late, they may be unable to attend the Event regardless of the reason, and We will not be able to issue a refund. The cancellation rights contained in the Consumer Protection (Distance Selling) Regulation 2000 (as amended) do not apply to the sale of Tickets.
b) It is unlikely, but we may have to make changes and/or correct errors and other details both before and after bookings have been confirmed. This can mean cancellation of confirmed bookings, and we reserve the right to do so. If the event is cancelled by Us for reasons within our control, You will be entitled to a refund of the Price, less any card charges. Refunds must be claimed within 1 month from the date of the event.
c) We will use reasonable endeavours to notify You if an event is cancelled or rescheduled, but You acknowledge and agree that it is your responsibility to check whether an event has been cancelled or rescheduled, and We have no liability for any failure to notify You.
d) Tickets and vouchers are only valid at the Event for the date and time specified in the confirmation email, and may not be offered in connection with any offer or exchanged for cash.
5. Conditions of admission
a) You shall comply with all policies, procedures and safety announcements in force at the Event, including any security procedures in place.
b) We reserve the right to refuse You admission to any event.
c) We reserve the right to request Customers to leave the premises.
d) You should retain your ticket as it may be required for re-admission.
e) Animals are not permitted within the venue, with the exception of assistance dogs.
f) The following items may not be brought into the Event. We reserve the right to check the contents of Customers’ bags and pockets before the Event. Any person found to be in possession of any of the items listed below may find that those items are confiscated and not returned and/or that they are denied entry to the Event:
(i) Alcohol.
(ii) Illegal drugs.
(iii) Weapons, potential weapons, or anything else which may in Our opinion, cause harm to others.
g) Any person who in Our opinion is felt to be under the influence of alcohol, drugs or any other prohibited substance may be denied access to the Event and no refund will be given.
h) We reserve the right to remove from the Event and from the site any person who is violent, abusive, threatening or disruptive or whose behaviour is causing distress to other Customers or staff, and no refund will be given. Persons who are instigating or participating in intimidation or violence will be reported to the Police.
i) Whilst the Event has been designed to be suitable for families, age restrictions apply and there must be at least one adult (18+) in every group taking part. The Event is suitable for children aged 12+, but parental discretion is advised as the Event features the challenging themes typically associated with Crime Scene Investigation so please consider this before booking. More sensitive Customers, including children may find some scenes, moments, and plot elements frightening, and the adult booking the Event should consider this carefully when booking as We are not responsible for making judgements regarding the personal disposition of individuals attending the Event. Refunds cannot be given should any Customer(s), including children decide not to commence or complete the Event. We cannot be held responsible for any adverse effects of the experience, subsequent rejections, or for those not admitted. If any Customer(s) could be judged to look too young for the event, they should bring identification (which includes a photo) showing their age.
j) All Customers attending the Event should be in good general health. Due to possible flashing lights, the Event is not suitable for epileptics. The Event is also not recommended for pregnant women, or persons with heart conditions or of a nervous disposition.
6. Accuracy
We use reasonable endeavours to ensure that the information contained on the Website and within printed literature is correct at time of being published. We reserve the right to make alterations.
7. Data Protection
We process Customer personal data in accordance with all applicable data protection laws.
8. Limitation of Liability
a) If We fail to comply with these Terms, We shall only be liable to You for the Price of the ticket, but We are not responsible for any loss, damages, costs or expenses You suffer.
b) We only supply tickets for private use. You agree not to use the tickets for re-sale purposes and We have no liability to You for any loss of profit, loss of business, business interruption, or loss of business opportunity, howsoever arising.
9. Events Outside Our Control
Should We need to change or cancel your booking for reasons beyond Our control, We will either reschedule your booking, or issue vouchers to the equivalent value of your booking. We will not be liable or responsible for any failure to provide, or delay in providing the Event that is caused by events outside Our reasonable control, which may include strikes, lock-outs or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks and the acts, decrees, legislation, regulations or restrictions of any government (“Force Majeure Event”) of any kind including lock-downs.
10. Variation Of The Terms
We have the right to revise and amend these Terms from time to time, including, but not limited to making changes to reflect current market conditions affecting Our business, changes in technology, changes in payment methods and changes in relevant laws and regulatory requirements.
11. General
a) Customers are not permitted to take photographs, video, or recordings of any sort on the premises, and mobile phones must be switched off during the Event. Please note your digital photo taken by Us is free for you to download. By accepting these Terms you grant permission for this digital photo to be used for Our promotional purposes which may include, but is not limited to social media. If you do not wish us to use the photo, or for it to be available via our social media platforms, you must make this clear to Us upon arrival.
b) Please see Our Website for parking details. It should be noted that visitors park at their own risk, and that they should allow time to find parking as it is often not possible to start the Event late, and no refund will be given.
c) Food and/or drink is not permitted inside the Event, unless provided by Us, and any person found to be in possession of food or drink may find that those items are confiscated and not returned and/or they are denied entry to the Event.
d) Comfortable shoes should be worn, and Customers should be aware that the Event may feature uneven ground and abrasive surfaces, so please wear resilient and robust clothes as We cannot be held responsible for clothes, footwear, jewellery, or other apparel including mobile phones or similar devices that may be lost or damaged.
e) Customers should be aware that due to the nature of the Event, volunteers and/or staff may make limited physical contact with Customers. There may be periods of darkness along with potentially frightening scenes and sounds during the Event.
f) The Event has been tested to ensure that for the majority of groups, completion will take the advertised time. We cannot however be responsible for groups who possess exceptional ability, may have taken part before, or were in some way privy to the workings of the Event. Customers who finish the Event early will not be entitled to a full, or partial refund.
g) If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such Term, condition or provision will to that extent be severed from the remaining Terms, conditions and provisions which shall continue to be valid to the fullest extent permitted by law.
h) These Terms represent the entire agreement between You and Us in respect of your use of the Website, ticket and Event, and shall supersede any prior agreement, understanding or arrangement between You and Us, whether oral or in writing.
i) You acknowledge that in entering into these Terms, You have not relied on any representations, undertaking or promise given by or implied from anything said or written whether on the Website, the internet or in negotiation between You and Us except as expressly set out in these Terms.
j) These Terms are governed by and construed in accordance with English law. The Courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of these Terms.
